Explaining Monday why he couldn't rule in favor of atheist Michael Newdow's challenge to the use of "under God" in the Pledge of Allegiance, Chief Justice William Rehnquist, who sided with the conservative majority in Bush v. Gore, said:
"When courts extend constitutional prohibitions beyond their previously recognized limit, they may restrict democratic choices made by public bodies."
That's a quote of the day if ever there was one.
