Feds ask that N.Y. ruling for ACORN be suspended

Federal Judge Nina Gershon had ruled twice in the last six months that cutoff of funding was unconstitutional

The government has asked a federal appeals court in New York to temporarily block a judge's ruling that it was unconstitutional for Congress to cut funding to the activist group ACORN.

A three-judge panel of the 2nd U.S. Circuit Court of Appeals in Manhattan did not immediately rule on the request after hearing the arguments Tuesday.

Attorney Mark Stern argued for the Justice Department that Congress did nothing wrong when it took action last year against ACORN after it identified widespread mismanagement.

Federal Judge Nina Gershon in Brooklyn had ruled twice in the last six months that the cutoff of funding was unconstitutional.
