OGDEN, Utah (AP) — Prosecutors have filed a capital murder charge against the suspected Utah pot-grower whose gunbattle with police left one officer dead and five others injured.
Matthew David Stewart was also charged with seven attempted aggravated murder charges, one count of production of a controlled substance and dangerous weapon enhancement on Friday in Ogden's 2nd District Court.
Weber County prosecutors also filed notice that they will seek the death penalty against Stewart.
Prosecutors say Stewart shot and killed Weber-Morgan Narcotics Task Force Agent Jared Francom during a raid on the 37-year-old Army veteran's home on Jan 4.
A message left for Stewart's attorney was not immediately returned Friday.
Stewart was shot by police but it was not clear whether he had been released from the hospital Friday and been booked into jail.
